What is the scope of this privacy policy?

This data protection declaration applies to all data that Netsuisse AG or Netsuisse Limited receives in the context of your use of the NETSUISSE website.

What information is collected by NETSUISSE?

We collect two types of data on our website:

Active data (e.g. name, postal address, e-mail address, telephone and fax number, credit card information, passport, gender, age), insofar as these are voluntarily transmitted by the user for the purpose of registration, participation in competitions, placing online orders, subscribing to an e-mail newsletter, etc. Most of the Internet services provided by NETSUISSE can be visited without personal registration and disclosure of identity. However, registration is required for some of the Internet services offered. If you do not wish to provide us with the required personal data, we may not be able to provide you with products and services.

Passive data (e.g. IP address, type of browser software used, the website from which you are visiting us, the pages of the NETSUISSE website you are currently visiting, including date and duration).

At no time does NETSUISSE establish a connection between the passive data and the personal data of the customer.

For example, what data is not collected?

On some websites you can recommend the NETSUISSE website to other people by e-mail. To use this function, we need to collect your e-mail address and/or the e-mail address of the person to be notified to whom you would like to recommend the respective NETSUISSE website.

The e-mail addresses collected for this purpose are not stored, but deleted immediately after your enquiry has been processed.

How do we collect and store information about you?

We use so-called tracking technologies such as cookies to collect data. You can set your browser so that you are warned about every tracking technology or you can generally block such functions. To whom do we disclose the data collected via the NETSUISSE website?

We will not sell, distribute or otherwise make recorded data available to third parties for a fee or free of charge. Our employees, agents, affiliated companies and third-party service providers who have access to personal   data collected via the NETSUISSE website are obliged to observe data protection.

We may also disclose your information to courts and/or governmental authorities or other persons in compliance with applicable regulations, orders, subpoenas, governmental requests or similar proceedings the extent or permitted by applicable law or to extent we believe in good faith that such action is necessary to comply with a court order.

We are also released from the duty of discretion and confidentiality for the assertion of legal claims against you.

In the event of a takeover of NETSUISSE, in its entirety or in parts, by a third party or in the event that NETSUISSE sells or disposes of parts of the company, the acquirer shall receive access to the stored data, including personal data. The same applies to the transfer of data in the course of reorganisation or insolvency proceedings.

How long does NETSUISSE store collected data?

We process and store active data (see section 3.a) for as long as is necessary for the fulfilment of our contractual and legal obligations or for the purposes pursued with the processing, i.e. for the duration of the entire business relationship (from the initiation, processing to the termination of a contract) as well as beyond that in accordance with the statutory storage and documentation obligations. It is possible that personal data may be stored for the period during claims can be asserted against our company and insofar as legitimate business interests require this (e.g. for evidence and documentation purposes).

We store passive data (see section 3.b) for six months and then delete it.

What security measures has NETSUISSE taken to protect your data?

We use our own assessment of suitable technical and organisational security measures to personal data against unauthorised access and attacks from outside, accidental or intentional manipulation, loss and destruction. Although cannot provide any guarantee whatsoever for protection against unauthorised external access, data loss, data misuse or data manipulation, we will make every effort to avoid such cases. In particular, we ensure compliance with data protection regulations by all NETSUISSE employees, both contractually and through consistent training.

What must be observed when data is transmitted via the Internet?

The Internet should generally not be as a secure environment. Unauthorised third parties can access information that you send via the Internet. This can lead to this information being disclosed or altered or to technical errors. Even if the sender and recipient are located in the same country, data sent via the Internet may leave the respective country and be forwarded to a country, in which less strict data protection regulations apply.

Data protection requirements are deemed to apply in the country in which you reside.

Although in many cases the individual data packets are transmitted in encrypted form, the names of the sender and recipient are not. Third parties could therefore draw conclusions about existing or emerging business relationships.

Note that we are not responsible or liable for the security of your data while it is transmitted to NETSUISSE over the Internet. In order to protect your data, we recommend that you choose another method of communication with NETSUISSE if you consider this necessary and appropriate.

How can the user contribute to data security?

In some cases, you have access to applications that can only be accessed via a personal user name and the corresponding password. The password is always encrypted during transmission over the network. We recommend that you keep your personal user name password secret and change them regularly. We recommend that you choose a password that is at least eight characters long and consists of at least one upper case letter, at least one lower case letter, at least one number and at least one punctuation mark. You are liable for any misuse resulting from unauthorised use of the password.

If there are reasons to believe that data security is not guaranteed or that misuse has occurred, we may change your user name, password or other codes and inform you of this in writing.

Please note that we will never ask you by e-mail to send your personal user name, password and/or other codes to NETSUISSE and/or third parties.

We only use valid SSL certificates. If your browser reports an error message regarding the invalidity or trustworthiness of these SSL certificates, please let us know. We also advise you to refrain from connecting to the possibly compromised website.
